Insurance agent gets compensation for delay in getting claim in Mumbai
An insurance company has awarded the insured Rs 8,000 thousand for the financial loss and mental agony he suffered due to the delay in the release of the money by National Insurance Company Ltd. and his medical expenses. The agency and the TPA have withdrawn the claim after 99 days instead of 30 days. The regional sales commission has ordered that the amount be paid within 15 days of the order, otherwise interest will have to be paid. 9 percent interest per year. The order dated November 16, 2022 by RG Wankhade, Chairman and SV Kalal, Member of the Mumbai Suburban District Consumer Disputes Supplementary Dispute Redress Commission in the complaint of Kandivali resident Kailashnath Dubey against National Insurance Company Ltd. and Medicare Services TPA (I) Pvt. Dubey, a national insurance agent, had taken out a health insurance policy from August 28, 2016 to August 27, 2018. During the policy, he had an accident and received treatment at a hospital. Despite repeated requests when Dubey did not get the money, he sent a notice in May 2017. The company finally gave him the money when he quit in July 2017. In his complaint to the commissioner, Dubey said that what he said will be decided within 30 days and not. He insists that during the delay, he had to borrow money to pay his hospital bills, which he was not repaid. Dubey has declared Rs 47,979/-, submitted an invoice of Rs 46,142/- and the declaration amount of Rs 24,692 was issued by NEFT after going through the terms and conditions of the policy.
During the hearing, the insurance company argued that the delay in paying the claims could be due to the resignation of the accounting department staff. Saying that such a dispute is not good, the Board said that the response of the Company should arrive within 30 days. It said that there is a deficiency in the work and ordered to be paid.
